Welcome to LivSmart. These Terms of Service ("Terms") govern your use of our websites and your communications with us. Please read them carefully.

These Terms apply to:

  • livsmartsolar.com (solar, battery storage, and smart home services)
  • ilivsmart.com (LivSmart Luxury Lighting, permanent architectural lighting)

By using either website, submitting a form, or opting in to receive messages from us, you agree to these Terms. If you do not agree, please do not use our sites.

1. Who We Are

LivSmart is a Nevada licensed contractor providing solar, battery storage, smart home, and permanent architectural lighting services in the Las Vegas valley and surrounding areas.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to request services, submit a form, or opt in to messages. By using our sites you confirm that you meet these requirements.

3. Our Websites Are Informational

Everything on our websites is provided for general information. Product descriptions, images, renderings, color representations, and sample results are illustrative. Actual installations vary with the design, dimensions, materials, and condition of each property.

Nothing on our websites is an offer to sell, a binding quote, or a guarantee of a particular result, price, or timeline.

4. Consultations, Estimates, and Quotes

Requesting a free design consultation creates no obligation for you and no obligation for us to perform work.

  • Estimates and quotes are valid only as stated in writing and may change after an on-site measurement.
  • No work begins and no price is binding until both parties sign a written agreement.
  • That signed agreement, not these Terms and not anything on the website, governs the scope, price, schedule, warranty, and cancellation rights for your project.
  • Nevada law gives you certain cancellation rights on home solicitation sales. Those rights are stated in your signed agreement and are not limited by these Terms.

5. Promotions, Discounts, and Referral Offers

From time to time we advertise promotions, seasonal pricing, or referral credits.

  • Every promotion is subject to its own stated terms, dates, and eligibility requirements.
  • Promotions cannot be combined unless we say so in writing.
  • Referral credits are earned only when the referred customer signs an agreement and the installation is completed and paid. Credits have no cash value unless stated otherwise.
  • We may modify or end any promotion at any time. Promotions already applied to a signed agreement will be honored under that agreement.

6. Text Message (SMS) Terms

By providing your mobile number and submitting a form, or by texting us first, you consent to receive text messages from LivSmart at that number, including messages sent using an automatic telephone dialing system.

  • Program description. Messages relate to your consultation request, appointment scheduling and reminders, project updates, service, and occasional promotional offers.
  • Message frequency varies.
  • Message and data rates may apply. Your carrier's standard rates apply.
  • To opt out, reply STOP at any time. You will receive one confirmation message and no further messages after that.
  • For help, reply HELP or call (702) 749-9834.
  • Carriers are not liable for delayed or undelivered messages.
  • Consent is not a condition of any purchase.
  • Supported carriers include major US wireless carriers. Carrier support may change without notice.

Your mobile information and SMS opt-in consent will not be sold or shared with third parties for promotional or marketing purposes. See our Privacy Policy for details.

7. Phone Calls and Recording

By providing your phone number you consent to receive calls from LivSmart and our representatives about your inquiry, including calls placed with automated technology or a prerecorded voice. Consent is not a condition of purchase. You may withdraw consent at any time by telling us on a call or by contacting us at the address in Section 15.

We may monitor or record calls for quality assurance and training. Where notice is required, we will provide it at the start of the call.

8. Acceptable Use

You agree not to:

  • Use our sites for any unlawful purpose
  • Submit false, misleading, or another person's information
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with the operation of our sites, including through automated scraping, bots, or denial-of-service activity
  • Copy, reproduce, or republish our content for commercial purposes without written permission

9. Intellectual Property

All content on our websites, including text, photographs, renderings, video, graphics, logos, and the LivSmart and LivSmart Luxury Lighting names and marks, is owned by LivSmart or its licensors and is protected by United States copyright and trademark law.

You may view and print pages for your own personal, non-commercial use. Any other use requires our prior written permission.

Installation photographs. With your permission, we may photograph completed installations and use those images in our marketing. We will not publish your name or street address without your consent. You may withdraw consent for future use by contacting us.

10. Third-Party Links and Services

Our sites may link to or rely on third-party websites and services, including analytics, advertising, scheduling, financing, and messaging providers. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that provider's terms.

11. Disclaimer of Warranties

Our websites are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties of any kind regarding the websites, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the sites will be uninterrupted, error free, or free of harmful components.

This section applies to the websites only. Warranties covering your installed products and workmanship are stated in your signed agreement and in the manufacturer's warranty documents, and nothing here limits them.

12. Limitation of Liability

To the fullest extent permitted by law, LivSmart and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of our websites, even if we were advised such damages were possible.

To the fullest extent permitted by law, our total liability arising from your use of our websites will not exceed one hundred dollars ($100).

This section applies to the websites only and does not limit our liability under any signed installation agreement, under any applicable warranty, or for any liability that cannot be limited under Nevada law.

13. Indemnification

You agree to indemnify and hold harmless LivSmart and its officers, employees, and contractors from any claim, loss, or expense, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of our websites.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules.

Any dispute arising from these Terms or your use of our websites will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to contact us at the address in Section 15 and give us thirty (30) days to attempt to resolve the matter informally.

Note: dispute resolution for an actual installation project is governed by your signed agreement, which may contain different terms.

15. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last Updated" date above. Your continued use of our websites after a change means you accept the updated Terms. The Terms in effect when you signed an installation agreement continue to apply to that project.

16. Severability

If any part of these Terms is found unenforceable, the rest remains in full force.

You should obtain and rely on an on-site assessment and written contract before making any purchase decision, verify all specifications and warranty coverage, and review all applicable permitting, HOA, or interconnection requirements.

This company disclaims all warranties to the fullest extent permitted by law for representations made by third parties and for illustrative materials or performance estimates. It is not liable for any damages, losses, or disputes arising from reliance on images, promotional materials, or online estimates. You agree to resolve any claims in accordance with the dispute resolution terms of your contract and applicable law.

By submitting your information through the referring website or this page, you consent to the sharing of your contact and property details with this company for sales and marketing purposes and acknowledge your acceptance of these terms.
